We are an online music label providing  a crowd funded solution to help musicians fund their music and music related projects by their fans or people who believe in them.

Before you begin using our interactive features, you must read and agree to these MOMLabel LTD Terms of Services ("Terms of Services") and the following terms and conditions and policies, including any future amendments (collectively, the "Agreement"):


DEFINITIONS
For the purpose of this agreement MOMlabel Ltd. can be referred to as momlabel.com or Momlabel ltd.
There are two types of registers on www.momlabel.com
  1. “The artist “  defined as  a composer, bands, singer or performer.
  2. “ The fan”   defined as a fan, a music investor, or someone who believes in the music of the artist  and interacts or follows an artist or artists.
  3. Also a fan an“Investor” is a person who has made a financial investment in one artist or more

FAN REGISTRATION
Fans/music investors can sign up for a free Fan profile account. The account can only be accessed by entering the fan's/ music investor’s personal log in Information. Fan’s will be given their own page homepage and their own public profile page on www.momlabel.com .

Each fan can then upload photos as well as use all the social networking tools and interact with account holders but, must comply with Momlabel Ltd.’s social media Terms & Conditions stated in this document. Only account holders will be able to become music investors.

FAN INVESTMENTS
A registered fan can invest in an artist using his credit card. We accept Visa and MasterCard for investments  of $10 increments can be made with a maximum of a $1000 per artist . This is so the artist can attract the maximum of fans. Every $10 = 1 share. You can view your investments,  on your homepage dashboard  and will see a tab called investments to track the artists  successes.

REFUND OF INVESTMENTS
You can request a refund minus the administrative charges by emailing refunds@momlabel.com
provided the artist has not reached his goal ( or for a period of 1 year) . You will either be credited onto your credit card or we will mail a check, please provide an accurate mailing address at that time.

ARTISTS REACHES IT’S GOAL :
Please check the FAQ on details on what happens after the goal has been met.
Please Note: As an investor you are responsible to report tax owed or comply with your country of residence tax laws for any revenue generated from your investment.  ____________________________________________________________________________

ARTIST REGISTRATION

An artist can sign up for a free account and use www.momlabel.com profile to interact
and accumulate fans. Each artist is given a home personal page and a public profile w/ a large banner, blogs, chats, photo albums, gigs alerts, and other social media tools. Artists profile account can only be accessed by entering personal Log in Information. An artist must have at least one picture, one song to keep their profile active or else the profile will be deleted with in 30 days. There are no exclusivity contracts to sign -up for MOMlabel.

ARTISTS PROJECT FUNDING PROCESS
An artist must sign up to start getting their project invested. On the artists personal home page you will see a large button that says “get funded” click on the large button and get your project funded.

AFTER ARTISTS YOU REACH YOUR GOAL
MOMLabel A & R team will contact you  to set up the process. You will also be offered formal contract. As an alternative to traditional labels, you will always keep all the rights and royalties to your music.

The requirements to raise funds:

You have your account set up to get funded for a period of one year. If you are at least 70%
percent funded at the end of one year you can apply for an extension our A&R team will evaluate your account and either approve an extension or not.

Please note: You may update your songs anytime on your investment dashboard.


CANCEL FUNDING
You can cancel your project anytime, your fans will be refunded their investment See the complete terms and conditions here before signing up

What information do we collect?
We collect information from you when you register on our site, place an order, subscribe to our newsletter, respond to a survey or fill out a form. Any data we request that is not required will be specified as voluntary or optional.

These security measures include: SSL (Secure Sockets Layered) technology to ensure that your information is fully encrypted and sent across the Internet securely.
We offer the use of a secure server. All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Payment gateway providers database only to be accessible by those authorized with special access rights to such systems, and are required to keep the information confidential.

Do we use cookies?

MOMlabel hosts various blogs, (collectively the "Services").  You will be responsible for all activities occurring under your user-name and for keeping your password secure. You understand and agree that the Services are provided to you on an AS IS and AS AVAILABLE basis. Momlabel ltd. disclaims all responsibility and liability for the availability, timeliness, security or reliability of the Services or any other client software. Momlabel ltd also reserves the right to modify, suspend or discontinue the Services with or without notice at any time and without any liability to you.

You must be at least thirteen (13) years of age to use the Services.  MOmlabel ltd.reserves the right to refuse service to anyone at any time without notice for any reason.

2. Proper Use. You agree that you are responsible for your own use of the Services, for any posts you make, and for any consequences thereof. You agree that you will use the Services in compliance with all applicable local, state, national, and international laws, rules and regulations, including any laws regarding the transmission of technical data exported from your country of residence and all European, United States export control laws.
You agree to abide by the Momlabel Content Policy www.momlabel.com and the rules and restrictions therein. Content of the Services. momlabel Ltd. takes no responsibility for third-party content (including, without limitation, any viruses or other disabling features), nor does momlabel Ltd. have any obligation to monitor such third-party content. momlabel Ltd. reserves the right at all times to remove or refuse to distribute any content on the Services, such as content which violates the terms of this Agreement. momlabel Ltd. also reserves the right to access, read, preserve, and disclose any information as it reasonably believes is necessary to (a) satisfy any applicable law, regulation, legal process or governmental request, (b) enforce this Agreement, including investigation of potential violations hereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, (d) respond to user support requests, or (e) protect the rights, property or safety of Momlabel ltd its users and the public. momlabel Ltd. will not be responsible or liable for the exercise or non-exercise of its rights under this Agreement.

5. Intellectual Property Rights. MOMlabel Ltd.  Intellectual Property Rights. You acknowledge that momlabel Ltd. owns all right, title and interest in and to the Services, including all intellectual property rights (the "momlabel Ltd. Rights"). momlabel Ltd. Rights are protected by U.K and international intellectual property laws. Accordingly, you agree that you will not copy, reproduce, alter, modify, or create derivative works from the Services. You also agree that you will not use any robot, spider, other automated device, or manual process to monitor or copy any content from the Services. As described immediately below, momlabel Ltd. Rights do not include third-party content used as part of the Services, including the content of communications appearing on the Services.
Your Intellectual Property Rights. momlabel Ltd. claims no ownership or control over any Content submitted, posted or displayed by you on or through momlabel Ltd. services.
You or a third party license, as appropriate, retain all patent, trademark and copyright to any Content you submit, post or display on or through momlabel Ltd. services and you are responsible for protecting those rights, as appropriate. By submitting, posting or displaying Content on or through momlabel Ltd. services which are intended to be available to the members of the public, you grant momlabel Ltd. a worldwide, non-exclusive, royalty-free license to reproduce, publish and distribute such Content on momlabel Ltd. services for the purpose of displaying and distributing momlabel Ltd. services. momlabel Ltd. furthermore reserves the right to refuse to accept, post, display or transmit any Content in its sole discretion.
You represent and warrant that you have all the rights, power and authority necessary to grant the rights granted herein to any Content submitted.

6. No Resale of the Services. Unless expressly authorized in writing by Momlabel ltd you agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes (a) any portion of the Services, (b) use of the Services, or (c) access to the Services.

7. Representations and Warranties. You represent and warrant that (a) all of the information provided by you to momlabel Ltd. to participate in the Services is correct and current; and (b) you have all necessary right, power and authority to enter into this Agreement and to perform the acts required of you hereunder.

8. Termination; Suspension. momlabel Ltd. may, in its sole discretion, at any time and for any reason, terminate the Services, terminate this Agreement, or suspend or terminate your account. In the event of termination, your account will be disabled and you may not be granted access to your account or any files or other content contained in your account although residual copies of information may remain in our system for some time for back-up purposes. Sections 2, 4-6, and 9 - 13 of the Agreement, along with applicable provisions of the general Terms of Services (including the section regarding limitation of liability), shall survive expiration or termination.]

9. Indemnification. You agree to hold harmless, indemnify and defend momlabel
, and its officers, agents, and employees from and against any third-party claim arising from or in any way related to your use of the Services, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys' fees, of every kind and nature. In such a case, momlabel Ltd. will provide you with written notice of such claim, suit or action.

10. Entire Agreement. This Agreement constitutes the entire agreement between you and momlabel Ltd. and governs your use of the Services, superseding any prior agreements between you and momlabel. You also may be subject to additional terms and conditions that may apply when you use or purchase certain other momlabel Ltd. services, affiliate services, third-party content or third-party software.

11. Waiver and Severability of Terms. The failure of momlabel Ltd. to exercise or enforce any right or provision of the Terms of Services shall not constitute a waiver of such right or provision. If any provision of the Terms of Services is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms of Services remain in full force and effect.

12. GOVERNING LAW AND JURISDICTION
This term and condition is governed by, applied and construed in accordance with British Law. Should a dispute arise with respect to the meaning of a term or provisions  or meaning in English language shall prevail.
Subject to public policy provisions applicable with respect to jurisdiction, the Courts of LONDON shall have sole jurisdiction over any dispute arising in connection with the
